All renters, co-renters, renter’s guests, renter’s relatives, renter’s partners and associates who use or intend to use or have used Luxed Vans LLC’s websites or Luxed Vans LLC’s vans, services, any associated (physical or otherwise) products or premises hereby forever release and waive their right to bring suit against Luxed Vans LLC’s owners, officers, directors, managers, officials, trustees, agents, employees, subsidiaries, partner companies or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing Luxed Vans LLC’s services vehicles and/or premises.
All renters, co-renters, renter’s guests, renter’s relatives, renter’s partners and associates who use or intend to use or have used Luxed Vans LLC’s websites or Luxed Vans LLC’s vans, services, any associated (physical or otherwise) products or premises understand that this waiver means they give up their rights to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim they may have against Luxed Vans LLC to seek damages, whether known or unknown, foreseen or unforeseen.
Anybody who plans on driving our vehicle must meet the following requirements:
• Valid driver’s license (or International Driver License along with your Passport).
• Some form of collision coverage (either through your own insurance policy, through credit card coverage, or by purchasing our Collision Damage
• You must be over 25 years of age to drive our vehicle.
• You must be fit to drive. We will not give you the keys if, in our judgment, you are inebriated, incapacitated, or otherwise incapable of driving
our vehicle safely.
Please furnish drivers licenses and proof of insurance for all drivers before you pick up your vehicle.

We require all renters to report any warning signs in the van to us or take the van to the nearest BENZ dealership for you during rental period. Our van requires 10,000 miles oil change and a safety check. Should one is needed, we shall reimburse all maintenance costs with receipt back to customer.
Call Roadside assistance, from your insurance company or call Mercedes Benz roadside assistance number 1-800-367-6372 and follow their instructions.
Additionally call us at 888-77-LUXED. If you have a flat tire, you are not allowed to change the tire by yourself.
Major Breakdown/ Accident Incidents:
Call 911 and if safe then Roadside assistance as above.
Assistance Under breakdown Policy:
In case of Trip interruption under breakdown policy, Following will apply
a. Send you a replacement LUXED Van OR
b. Help provide you a rental vehicle from another Rental company (they may have a different pricing than ours)
In that case our rental agreement will close immediately and you will continue with new rental company.
c. We shall cover upto 1 night stay for 2 hotel rooms after pre-approval.
Each authorized driver is responsible for all damage or loss caused to others including all damages to Luxed Vans Rental (please see RCP section if RCP bought) vehicles and agrees to provide auto liability, collision and comprehensive insurance covering covering all /any parties involved.
For personal rentals, Every driver need to have at least $100,000 liability insurance OR the state minimum wherever the Rental vehicle is to be driven.
For commercial rentals, insurance with minimum of 1 million liability in your company name needed.
“Loss of Usage” during vehicle repairs:
Please ensure that Loss of Usage charges will apply to you at the same daily rate as the original daily rental rate as long as the rented vehicle remains in the shop under repairs including any or all wait times. (please see RCP section if RCP bought). The Loss of Usage period starts from the time the repair estimate has been sent to the customer to the time vehicle is released from the repair shop.
Please ensure that your rental insurance has coverage for “Loss of Usage” for the same. Such Loss of Usage charges to be waived if RCP has been purchased.
We provide optional Rental Collision Protection (RCP) for $18/day which covers up to $20,000 of claim with $250 deductible.
“Loss of Usage” charges will be waived if RCP has been purchased.
Sub-letting or sub-renting or sub leasing the vehicle in this contract is strictly prohibited. Driving the vehicles other than listed Drivers is strictly prohibited. Any such action will be deemed violation of this Contract and subjected to penalties up-to 10 times this contract value.
All payments including refundable security deposit are due immediately before delivery and any incidentals immediately upon the return of the rental.
Security deposit is refundable minus any incidentals.
For non-Camper vans, we are the only shop to provide seat re-configurations to allow for additional Legroom (upto 4 feet) $79

** Any changes in Valet Service (addition / cancelation) within 24 hours of actual Delivery/Return will be double the regular charge.
Upto 4 Authorized drivers could be added for free, every additional driver will be subjected to $25 Admin fee.
If you need any roadside assistance for any minor issue please call your insurance company roadside assistance number or call Mercedes Benz roadside assistance number 1800-367-6372 and provide the VIN number located on the dash in front of the driver and follow their instructions, at the same time call us at 832 819 1881. Please take the picture of all incidents and text to us.
If you have a flat tire, you are not allowed to change the tire by your self. Call roadside assistance for help.
Each van comes with HCTRA EZTag that lets you drive through Texas toll ways without stopping. Renter is responsible for all such regular tolls and any violations related to other tolls fees (in other states) and parking fees etc during the time of your use. If fine remains unpaid and we receive a delinquent violation notice we will charge an administration fee in addition to the fine to pay and process the fine on your behalf.

All rates are based on a 24-hour “rental day” starting at the time of rental. For partial hours, a prorated charge will be assessed upto 8 hours after which full day charge will be assessed.
We do welcome 1 Day rentals subject to the following conditions:
For non-Camper vans:
Peak Periods (From Nov15 To Jan15) and (From May15 To Aug15):
For 1 day booking, Additional 100$/day on top of published Rate
Non-Peak Periods (Any other time of the Year):
For 1 day booking, Additional 50$/day on top of published Rate
Please use the Fuel Type listed on the Fuel Tank/Cap on the vehicle. Using any other fuel will severely damage the engine that will be the sole responsibility of the renter.
Each Van comes with a Full Delivery / Return Pickup
For the Non-Camper Van:
Pre-paid Fuel (Gas/Diesel) can be purchased for $75. If not returned full (or at the same level as of Delivery point); Charge will be double the original Pre-paid offer.
For the Camper Van:
Please see the terms under “Additional Terms and Conditions for Camper Vans”
Without prior approval extension:
Any delays up to 2 hours will not be charged.
After 2 hours, it will be twice the full day charge with no discounts if offered at the contract time.
With prior approval extension:
It will be just the full day charge with no discounts if offered at the contract time.
Any extensions (approved or un-approved) shall not provide additional free per day miles by default.
Any additional miles will still be charged @per mile rate on top extensions above.
Under some circumstances and with prior approvals, we do allow unmanned returns with a Drop-off key facility. Customer would agree that the return inspection could only be completed on the next working day and any damages or vehicle condition will only be brought to customer’s attention at that point only.
For unmanned returns, customers will have to self-report the mileage and vehicle fuel levels at the minimum via a picture message.
E and L Series vans come with free 250 miles/day – After that 38c/mile
C and X series vans come with free 200 miles/day – After that 49c/mile
All Camper Vans (R-series) come with free 150 miles/day – After that 59c/mile
Customers are responsible to plan their trips diligently and purchase additional miles in advance at published rate above.
Any unpaid but used miles above 100 allowed miles will be subject to double the per mile published rate per the van class.
Any paid but unused miles utpo 100 miles will be not be refunded.
Any paid but unused miles above 100 miles will be refunded at the per mile published rate.
Outside Wash: Strictly prohibited to wash the vehicle from outside since its unsafe – covered under cleaning fee.
Inside Cleaning – Just bring it reasonbly clean of trash – covered under cleaning fee.
Any spills or stains may require special cleaning that may cost additional $150 – not covered under cleaning fee.
STRICT: Smoking is not allowed in any of our vans.
The smell or any trace of smoking will be result in a minimum cleanup and detailing charge as follows……..
Regular Vans: 500$
Executive Vans: 750$
Camper Vans: 1000$
Please note: In addition to above, any “loss of usage” of the van as a result of smoking related cleanup and detailing will be additional per day charge at the published van rate for minimum of two days. It may be more if there is an active follow-on booking on the van.
Our vans have a high ceiling, so you are not allowed to drive through and any parking garage less than 12 feet high, and the length of the van is 23 feet long. It is your duty to obey the traffic rules and regulations of the places you visit. And also we recommend you to drive at a low speed or stop in a safe place during windy conditions or hazardous conditions.
For non-camper vans, loss of any portable device like TV/dvd remotes or Jetpacks will result in loss fee of $100 if not returned before contract close. Contracts are generally closed 24-72 hours after van return. Such fees may be refunded later once the device is returned after contract closure but within one week.
Van Loss keys charges are $600 and additional $100 to overnight the key if you lose one on the trip.
WiFi service/speed varies by van location and no refund will be issued for the same.
All contract closings and resulting Security refunds will be completed within 24-72 hours after van return except in case of noted damages where it will be longer. This is needed for the Tolls (Texas only) to settle.
Customer is fully responsible to check the van at the Delivery Point to his/her satisfaction.
Customer has the right to reject the van at that delivery point and limit his/her loss maximum to the Reservation Amount only.
Customer fully understands that once the van is accepted (under any circumstances), the full contract amount will be payable to Luxed Vans.
Specifically no refunds for early returns.
Any major claims regarding mechanical failure of the van while on the trip will be subject to Luxed Vans Breakdown Policy.
Any other claims including cleanliness or vans’ or van related amenities’ mis or under-performance will be considered trivial.
Such trivial claims will not qualify for any REFUNDS or later Credit Card CHARGEBACKs.
Its entirely and strictly upto Luxed Vans Management’s discretion to honor any refunds beyond above policy but Customer shall waive his/her rights to enforce any.
For non-Camper Vans:

#1 Non-functional items (after delivery point)
All our camper vans are standard factory products and renters are responsible to follow the supplied manuals as far as usage is concerned.
We try our best to explain the necessary functions at the delivery point but the list may not be complete.
Renters are hence advised to ask for walk through of every items they intend to use during the trip including bathroom / kitchen / generator / grey-black-freshwater pump functions / TV / Wifi / Entertainment functions etc.
Though we shall still try to accommodate for any inconvenience, we can not be held liable under any circumstances for anything non-functional items after the delivery point.
Renter will be 100% liable for any damages caused to the camper van by the user error that will be deducted from the user’s deposit and billed separately for any excess beyond including any legal/accounting fees. Please note that such user error related damages may not be covered by the your or our purchased insurances.
#3 Road-side assistance
All rentals come with road-side assistance with its terms that renter will abide by.
Under certain circumstances, we may send our RV technician to your location which may be a separate charge of 250$ + transportation+boarding+Lodging per day if the source of the issue was determined to be a user-error.
#4 Miscellaneous Points
Each camper van rental comes with clean grey and black water tanks, full fresh water tank, full diesel tank and propane gas tank. This is generally as shown on the gauges in the van and will need to be verified by the renter at the delivery point.
At the return point each of the above tanks is to be returned with the same statuses and we shall verify from the gauges including any receipts that you may have. (hence save the receipts).
All above services may be pre-purchase each at 100$ each and will not result in any penalties at the time of return.
However if not pre-purchased and in case the above conditions are not satisfied at the point of return, each item will result in the charges as below:
Grey and Black water disposal = 200$
Full fresh water fill up = 200$
Full diesel tank fill up = 200$
Propane Tank fill up = 200$
Luxed Vans supplied insurance is originally supplied by a third party vendor and subject to $1000 deductible and have their own stipulations that renter will abide by.
If renter choose to decline our insurance and chooses to use his own, it will be incumbent on the renter to insure that their insurance will transfer to our camper van for any and all liabilities in case of an accident irrespective of whether the van is moving or stationary. This includes Liability coverages ( Bodily injury liability and Property damage Liability), Comprehensive and collision coverages, Medical payments coverage / Personal injury protection, uninsured and under-insured motorist coverage etc.
Under any circumstances if renters own insurance fails to cover any of the liabilities mentioned above, renter will himself personally be responsible for any and all liabilities and will bring no liability to Luxed Vans management, owners, investors, subsidiaries etc directly or indirectly, foreseen or unforeseen.

(Party 1) All renters, co-renters, renter’s guests, renter’s relatives, renter’s partners and associates who use or intend to use or have used Luxed Vans LLC’s websites or Luxed Vans LLC’s vans, services, any associated (physical or otherwise) products or premises hereby explicitly give consent to (Party 2)Luxed Vans LLC’s owners, officers, directors, managers, officials, trustees, agents, employees, subsidiaries, partner companies or other representatives for on-premise or off-premise video recordings, phone recordings and Luxed Vans LLC’s vehicle tracking related to an expected, on-going and completed van rental transaction.
Such recordings may be used by Luxed Van LLC for any purpose deemed suitable by Luxed Vans LLC’s management.
(Party 1) All renters, co-renters, renter’s guests, renter’s relatives, renter’s partners and associates who use or intend to use or have used Luxed Vans LLC’s websites or Luxed Vans LLC’s vans, services, any associated (physical or otherwise) products or premises hereby agrees, to the fullest extent permitted by law, to limit the liability of (Party 2) Luxed Vans LLC’s owners, officers, directors, managers, officials, trustees, agents, employees, subsidiaries, partner companies or other representatives to Party 1 for any and all claims, losses, costs, expenses, or damages of any nature whatsoever, including attorney and expert-witness fees and costs, from any cause or causes, so that the total aggregate liability of the Party 2 to the Party 1 shall not exceed the total value of the Rental Contract / Order. It is intended that this limitation apply to any and all liability or causes of action however alleged or arising, unless otherwise specifically prohibited by law.
All claims and disputes arising under or relating to any Luxed Van LLC’s Agreement shall be settled by binding arbitration in the state of Texas. The arbitration shall be conducted on a confidential basis pursuant to the Commercial Arbitration Rules of the American Arbitration Association. Any decision or award as a result of any such arbitration proceeding shall be in writing and shall provide an explanation for all conclusions of law and fact and shall include the assessment of costs, expenses, and reasonable attorneys’ fees. Any such arbitration shall be conducted by an arbitrator experienced in Car/Van Retal industry and shall include a written record of the arbitration hearing. The parties reserve the right to object to any individual who shall be employed by or affiliated with a competing organization or entity. An award of arbitration may be confirmed in a court of competent jurisdiction.
